As long as you have a company handbook and it tells you what to do in response to sexual harassment, first thing that you need to do is comply with what your manual tells you to do. It will tell you who to report, and whom to report it to, and how you do it. If they don’t take care of it, go up the chain of command to report it. Now, let’s say you followed policies and procedures and they don’t address it, or the person who is the perpetrator is so high up, you’ve got nowhere else to go. What can you do then?
There is a procedure under the EEOC, Equal Employment Opportunity Commission. You’ve got to make your complaint to them. They will investigate. They will render a determination. Your first step really before any of this, before going to the EEOC is to contact an employment attorney. Have them investigate what’s going on, tell you what, if anything, further you need to do to be in compliance with your employee manual, and if you have no other options, how to appropriately make a claim, and start an investigation with the EEOC.
